Terms of Membership
By registering for membership, you agree to AW, Inc.'s Terms of Membership
Agreement for your involvement in and use of the Seducity services.

1. General
The Seducity service is provided by AW, Inc., Inc. ("AW, Inc."
or "we") to you ("Member" or "you"), subject
to the terms of this Agreement. Any technical support for Seducity that
may be provided by AW, Inc. is also subject to these Terms of Membership.
The AW, Inc. Terms of Membership comprise the entire agreement between
AW, Inc. and you, and supersede any other agreement, written or oral,
relating to AW, Inc. provided, however, that AW, Inc. may revise the
AW, Inc. Terms of Membership at any time, and such revision will be
effective when the revised AW, Inc. Terms of Membership are posted here.
If any such revision is unacceptable to you, you may terminate your
Membership as provided below. Your continued use of Seducity, following
notice of any revision the AW, Inc. Terms of Membership will be conclusively
deemed acceptance of all revised and new AW, Inc. Rules.
2. Registration and Account Information
To use Seducity, you must register as a Seducity Member, upon which
you will be provided a password and an Avatar identity ("Avatar
Identity"). You agree to provide AW, Inc. with accurate and complete
registration information. Failure to do so will constitute a breach
of this Agreement and unauthorized access to the worlds, and may result
in immediate termination of your account. Correct information including
billing information, phone number, email address and member name is
required. AW, Inc. reserves the right to cancel any account where incorrect
information has been provided. Failure to do so will constitute a breach
of this Agreement and unauthorized access to the worlds, and may result
in immediate termination of your account.
You may not select or use a name of another person for your Avatar Identity
name in violation of the rights of any person, or an Avatar Identity
name that AW, Inc. deems offensive.
Where and when it is made available, limit one trial membership per
family. Members may not create multiple accounts in order to harvest
tokens. Such multiple accounts will be terminated, and the account holding
the accumulated tokens is also subject to termination as determined
by Seducity staff.
You are responsible for maintaining the confidentiality of your password
and are solely liable for any harm resulting from disclosing or allowing
disclosure of a password or from its resulting use by any person. At
no time should a Member ever respond to an online request for a password.
Employees from AW, Inc. will never ask for a Member's password online,
except via e-mail.
Many areas of our worlds are open to all Members (defined as "Public
Areas" or "Free Areas"). There are also certain areas,
which are only open to certain Members, and generally by invitation
only. These are "Private Areas," or "turfs/apartments,"
or "backstage areas." Membership in our worlds does not guarantee
you access to any Private Areas, as entrance into Private Areas is determined
by the Members/entities who sponsor such Private Areas.
3. Charges
You will be charged for usage of the Seducity service in accordance
with the current billing procedures and guidelines. AW, Inc. will notify
you of any changes in the fees in the future, at which time you will
have the option to terminate your Membership or pay the amended fees.
Seducity membership does not cover any telephone access or Internet
service charges you may incur in the course of using AW, Inc. worlds.
You are responsible for canceling your own account if you no longer
wish to be a member of Seducity. Canceling your account will end your
service at the end of your billing period. You may find links to the
Account Manager on the join page.
4. Server inaccessibility, Deletion
and/or Loss of Avatars, Virtual Possessions and Turfs
NOTE: If you do not access your account or any of your avatars
(even though you have accessed other avatars on your account) for any
90 day period your avatar and all its possessions will be permanently
removed from our database and cannot be restored. All cancelled accounts
are not recoverable after 90 days from cancellation. AW, Inc.,is not liable for or is obligated to replace any lost or
stolen virtual possessions. IMPORTANT: AW, Inc. has no control, liability
or responsibility for any interception and unauthorized use by any third
parties of any such communications. You are solely responsible for maintaining
the secrecy of your passwords and/or any account information. Please
be careful and responsible whenever you're online and DO NOT REVEAL
YOUR ACCOUNT ID, PASSWORD OR OTHER PERSONAL INFORMATION TO ANY OTHER
MEMBER OR THIRD PARTY. AW, Inc. staff will NEVER ask you for
your password but may ask you for your account ID. Likewise, AW, Inc.
staff will NEVER send you any unsolicited emails with attachments, unless
you have been communicating privately with our Support group.
All software upgrades will ONLY be available from our web sites. AW,
Inc. makes every attempt to provide 24/7/365 access to SeduCity. However,
planned and unplanned maintenance events are likely, and therefore we
do not guarantee access at any time.
5. Rights and Responsibilities
(a) Conduct and Communication.
You agree to access SeduCity only for lawful purposes and in accordance
with the AW, Inc. Terms of Membership Agreement. AW, Inc. may elect
at its sole discretion to monitor the Public or Private Areas of AW,
Inc. for compliance with the AW, Inc. Rules. You further agree
not to publicly discuss bestiality, incest, pedophilia or any other
illegal topics. You agree to use common courtesy and conduct
yourself in a civil and appropriate manner when communicating with others
while using AW, Inc.'s services. Any conduct that in AW, Inc.'s sole
discretion is inconsistent with the AW, Inc. Rules will not be permitted,
and will entitle AW, Inc., in its sole discretion and without notice,
to limit membership privileges or immediately terminate such Member's
membership. Hacking, patches, and denial of service activity are strictly
prohibited.
You may not engage in spoofing or otherwise impersonating any persons
in the course of using AW, Inc. worlds. To "spoof" or "impersonate"
means to assume another person's identity in such a manner that, in
AW, Inc.'s sole discretion, a reasonable person does not or would not
know that you are not in fact such person, and/or to assume another
person's identity in such a manner that, in AW, Inc.'s sole discretion,
is offensive, embarrassing or harmful in any manner to any person or
AW, Inc.
Harassment of another member.
The term "harassment" means to repeatedly annoy another person,
and as in the real world, constant annoyance often ends in a complaint
to a controlling entity. And as in the real world, harassment is difficult
to prove, and seldom one sided. Therefore, our determination that harassment
has occurred is based on this rule:
-Text oriented harassment
Any member found to have repeatedly used insults and/or abusive language
in one interchange (conversation with one other person) can be considered
guilty of harassment, PROVIDED the transcript clearly indicates the
member whom initiated the harassment, and that a staff member was paged
and/or witnessed the interaction.
-Avatar movement oriented harassment
Any member who repeatedly conducts unwanted, sexually oriented avatar
movements on another member, after being told that his or her actions
are inappropriate and are unwanted can be considered guilty of harassment,
PROVIDED that a staff member was paged and/or witnessed the interaction.
When we receive harassment complaints from a member, we do the following:
1. For text oriented harassment situations we ask the member to record
any text that proves harassment. They must provide at least three text
transcripts, one for each of three separate harassment instances, in
order for us to take action. Less will not constitute "harassment".
For avatar movement oriented harassment situations we record each proven
report of harassment, and after three separate instances, we can then
take action.
2. We then talk to the offending member and warn them that this behavior
will not be tolerated, and that another instance will result in a 24
hour muting of their avatar. Two proven complaints will result in cancellation
of the member's account and three proven complaints instances will result
in a 12-month ban from SeduCity.
3. We advise the member claiming harassment to use the "ignore
this avatar" function, to avoid further interchange. If the member
claiming harassment instigates any conversation in SeduCity with the
offending member, we are unable to help further, as we then view the
harassment as being reciprocal.
4. If the harassment has happened repeatedly in one specific locale,
we ask the member claiming harassment to avoid that particular locale.
Although this request may seem to limit the rights of the member being
harassed, it forces the harasser to either give up, or attempt to find
the member they have been harassing. This second option provides us
with substantial evidence to bring the situation to a close.
5. If a member is proven to have harassed three members or more and
has had three separate complaints filed against him or her, he or she
will be permanently banned from all AW, Inc. worlds.
Other harassment issues.
Placing slanderous or defamatory remarks about another member on a "tell
me about" tag is considered to be in violation of these Terms of
Service. Any member doing so will be asked to remove it. If the member
refuses their avatar will be force ghosted until the TMA is removed.
A second occurrence will result in the offending member's avatar being
ghosted for 14 days, regardless of whether or not the offending TMA
has been removed before the ghosting period is complete. A third instance
will result in the banning of the offending member.
You are entirely liable for all activities conducted in SeduCity
through your Avatar Identity. In cases where you have authorized another
individual, including to use your Avatar Identity you recognize that
you are fully responsible for the online conduct of such user. You must
not allow any minor to have access to your account or to view SeduCity.
You acknowledge that some areas of AW, Inc. may contain material that
is inappropriate for minors. AW, Inc. reserves the right to restrict
access to certain parts of the Seducity service based on a Member's
age or any other criteria it deems relevant. You further agree not to
publicly discuss bestiality, incest, pedophilia or any other illegal
topics.
(b) Content.
Our virtual worlds and associated web pages may contain information,
communications, software, photos, video, graphics, music, sounds and
other material and services (collectively, "Content"). Such
Content may be provided under license by independent content providers
("Independent Content Providers") and other Seducity Members.
Each Member and Independent Content Provider must evaluate and bear
the risk associated with, the accuracy, completeness or usefulness of
any Content. AW, Inc. does not pre-screen Content. AW, Inc. has the
right, but not the responsibility, to remove Content which is inconsistent
with the AW, Inc. Rules.
(c) No Pre-Screening of Communications or Content.
You agree that AW, Inc. cannot determine in advance the accuracy, or
conformance to the AW, Inc. Rules, of communications and Content transmitted
on AW, Inc. . AW, Inc. is not responsible for screening, policing, editing,
or monitoring such communications and Content. If notified of communications
or Content which are alleged not to conform to the AW, Inc. Rules, AW,
Inc. may determine in good faith and in its sole discretion whether
to remove or request the removal of such Content from AW, Inc. , or
take other action as deemed appropriate by AW, Inc.. AW, Inc. has no
liability to you in respect of its performance or non-performance of
such activities.
(d) AW, Inc. and Third Party Rights.
Content may be protected by copyrights, trademarks, and other proprietary
rights of AW, Inc. and third parties ("Rights"). Your use
of Content will be governed by applicable copyright and other intellectual
property laws. You agree to transmit on or through AW, Inc. only Content
that is (i) not subject to any Rights, or (ii) expressly licensed by
the holder(s) of such Rights for distribution on AW, Inc. worlds. By
transmitting Content to any Public Area and/or submitting Content to
AW, Inc. (including but not limited to the submission of any ideas of
how to improve AW, Inc.), you hereby grant, and warrant that AW, Inc.
has the royalty-free, perpetual, irrevocable, non-exclusive worldwide
right and license to use, reproduce, adapt, translate, create derivative
works from, distribute, transmit, perform and display such Content (in
whole or part) and/or to incorporate it in other works in any form,
media, or technology now known or later developed for the full term
of any Rights in such Content and grant to each Member the further right
and license to access, view, store and reproduce the Content for personal
use. Furthermore, you agree to abide by the U.S. and other applicable
export control laws and not to transfer, any Content, which is subject
to such laws without complying with any requisite government authorization.
(e) Advertisement and Third Party Products/Services Advertised In
SeduCity.
You may not advertise any real world products or services without the
express written consent of AW, Inc.. To the extent AW, Inc. authorizes
such advertising, AW, Inc. does not endorse or guarantee any product
or service, and will not be a party to any transaction between you and
any third-party provider of such products or services. Furthermore,
you acknowledge that by clicking on certain icons located in the SeduCity
of advertisers or other third parties, you may be linked to Internet
web sites/locations that are not controlled by AW, Inc. There may be
some content on these third party web sites/locations to which you may
be linked which may be offensive to some individuals, or which may not
be in compliance with legal requirements and other rules, including
these Terms of Membership. AW, Inc. assumes no responsibility for and
does not endorse the content contained on any such web sites/locations.
(PLEASE NOTE THAT THE "TOKENS" AND ANY OTHER "PLAY CURRENCIES"
OFFERED THROUGH AW, INC. HAVE NO REDEEMABLE VALUE, AND MAY NOT BE USED
TO PURCHASE ANY "REAL" PRODUCTS OR SERVICES ADVERTISED THROUGH
AW, INC. WORLDS.)
(f) Privacy Policy.
Whereas your personal information will never be provided to any third
party by AW, Inc. for commercial purposes without your permission (See
Privacy Policy below), AW, Inc. retains the right to make exceptions
and release your Member Identity Information in appropriate circumstances,
as determined in AW, Inc.'s sole discretion, such as: (a) to comply
with law or legal process, (b) to protect the rights or property of
AW, Inc. and others, (c) when a person's physical safety may be at risk,
or (d) in connection with investigations regarding activities which
break any laws. Please also note that because your access to a AW, Inc.
World is via the Internet, any of your communications, intended to be
private or otherwise (including submission of your password), as you
send them over the Internet to a AW, Inc. virtual world may be intercepted
by others. AW, Inc. has no control, liability or responsibility for
any interception and unauthorized use by any third parties of any such
communications.
Privacy Policy
The policies below
are applicable to SeduCity communities and other sites on the Internet
owned and operated by AW, Inc., Inc. Please read the following privacy
statement that discloses our information gathering and dissemination
practices.
1. General
TO THE EXTENT ALLOWED BY LAW, AW, INC. FROM TIME TO TIME MAY SELL OR
TRADE ITS LIST OF MEMBER IDENTITY INFORMATION TO THIRD PARTIES. IF YOU
DO NOT WISH TO HAVE YOUR SPECIFIC MEMBER IDENTITY INFORMATION INDIVIDUALLY
DISCLOSED TO ANY SUCH THIRD PARTIES, AND/OR YOU DO NOT WISH TO RECEIVE
ANY OFFERS THAT WE BELIEVE MAY BE OF INTEREST TO YOU FROM AW, INC. OR
ITS AFFILIATED COMPANIES, YOU MUST INDICATE THIS UPON REGISTRATION.

Should you select to have your Member Identity Information withheld,
AW, Inc. has the right to make exceptions and release your Member Identity
Information in appropriate circumstances, as determined in AW, Inc.'s
sole discretion, such as:
1. to comply with law
or legal process,
2. to protect the rights
or property of AW, Inc. and others,
3. when a person's
physical safety may be at risk, or
4. in connection with
investigations regarding activities which break any laws.
2. Information Obtained
Our registration process requires users to give us contact information
(such as their email address), and demographic information (like their
zip code, age, or income level). We use customer contact information
from the registration form to:
1. Send the user registration information
2. Send information about our company
3. Send promotional material from some of our partners.
Users may opt-out of receiving future mailings; see the Choice/Opt-in
section below. Demographic and profile data is also collected at our
site. This information may be used only by AW, Inc. for advertising
targeting. Aggregated demographic information may be utilized to sell
advertising to advertisers.
3. What You Should
Know About Your Privacy
Please note that because your access to SeduCity is via the Internet,
any of your communications, intended to be private or otherwise (including
submission of your password), as you send them over the Internet to
SeduCity may be intercepted by others.
AW, Inc. has no control,
liability or responsibility for any interception and unauthorized use
by any third parties of any such communications. Ultimately, you are
solely responsible for maintaining the secrecy of your passwords and/or
any account information. Please be careful and responsible whenever
you're online.
4. IP Addresses
IP addresses are monitored and tracked by us, but this information is
used strictly for administration purposes and is never shared with outside
parties.
5. Links to Other Sites
Our web sites may contain links to other sites. AW, Inc. is not responsible
for the privacy practices or content of such sites. However,
you are not allowed to link to sites or discussion groups, etc., with
content including: bestiality, incest, pedophilia or any other illegal
topics.
6. Public Forums
Seducity communities extend themselves to forums, message boards, and/or
news groups. Any information that is disclosed in these areas becomes
public information and you should exercise caution when deciding to
disclose your personal information.
7. Choice/Opt-In
We provide users the opportunity to opt-out of receiving
communications from us and or our partners. We give users the option
to unsubscribe and therefore no longer receive future communications
from us and or our partners.
· Upon registration,
you may elect to not receive these communications by selecting the "Do
Not Include Me" button.
· After registration, you may use the Account Manager to remove yourself
by selecting the Edit Contact Info and removing the check inside the
box "Subscribe to Newsletters".

Guidelines for Community Oriented Behavior
INTRODUCTION TO OUR
GUIDELINES
These Guidelines are
provided to help make usage of the SeduCity a positive experience for
all members. The virtual community is created and tended by the Inworld
Volunteer Staff and AW, Inc. employees.
Actions that are subject to being excluded from our worlds include:
· Abusing other members
or staff verbally, via ESP, screen text, gestures, or any other means
of communication. This includes ESP-bombing and interruptions during
events.
· Impersonating another member or staff member.
· Knowingly disrupting an event.
· Stealing the inworld possessions of other members.
· Slander of other members. (See verbal abuse and Harassment above.)
INTRODUCTION TO AW, INC.'S ZONES AND THE COMMUNITY
Participation in our
virtual zones is not a game. It is real life, lived through your avatars
in a virtual online community. The avatars you will meet in these worlds
("inworld") are real people, not programmed game opponents.
Members are part of a living and growing community. We are much more
than a collection of people or a virtual chat room. We have our own
history, culture, stories, and taboos. AW, Inc.'s zones and our web
forum areas provide an opportunity to explore and experiment with our
social skills while enjoying the community found here. This exploration,
however, should not come at the expense of other community members'
enjoyment.
REMEMBER, WE'RE ALL
HUMAN
The most important
thing to remember at all times in this or any online community is the
person behind the machine. Just as you sit at your keyboard, communicating
with other community residents through your online persona, there are
real human beings all over the world communicating in the same manner.
Approach others online with the same courtesy and respect that you would
expect in real life. Always remember that online actions can have real
world effects, so think for a moment, "What would I do if we were
face to face?" Consider the feelings of those other people in all you say and do.
Respect others requests to refrain from behavior they or others may
find offensive, and be forgiving of others mistakes. Take care to show
consideration and respect and treat others as you would have them treat
you. Think before you speak or act, or you may make mistakes that will
prevent you from making friends and becoming a part of the community.
After all, being a part of the community is what this world is all about.
Just because you *can* do something, doesn't mean you *should*.
COMMUNICATIONS
The majority of human
communications are nonverbal. Remember that through this electronic
medium much of what you wish to communicate may not come across through
words alone. Very often a different life or a different language can
add a different meaning to the words or expressions you use or hear.
Make the extra effort to understand one another's meaning or point of
view.
Before you speak, think,
and refrain from obscene or offensive language. This applies to a public
message. Remember that typing in all caps is SHOUTING, use *asterisks*
or _underlines_ to emphasize a word or your words alone to convey the
emotions.
ADULTS AND MINORS
AW, Inc. does not knowingly
allow minors to enter SeduCity. Although we do not control or try to
manage the interaction between members, we do demand that members do
not harass or impose unwarranted sexual or verbal advances on others.
We reserve the right to censor or banish any member who we deem is overstepping
the commonly accepted parameters of on-line interactions.
RESPECT ONE ANOTHER AND RESPECT THE SERVICE
Please respect the rules, others with whom you share the service,
and the staff members who work hard to improve upon and provide you
these services. Adherence to these guidelines will help to make your
and others use of the service a positive experience.
PERSONAL ACCOUNTABILITY
You must recognize your own responsibility in having access, and
allowing others access to your accounts. The person to whom the account
is registered is responsible for any actions from their account.
USE OF THIS SERVICE IS PRIVILEGE, NOT A RIGHT
Use of AW, Inc.'s virtual zones is a privilege, not a right, and
those privileges can be revoked at our discretion. Failure to comply
with the guidelines detailed herein can lead to warnings or your account(s)
being denied access to (locked out of) the world areas temporarily or
permanently.
AGREEMENT
By choosing to become a member of an AW, Inc. virtual zone, you agree
to follow these Terms of Service and Guidelines.
